1. Purpose of this Privacy Policy

This policy explains the basis on which ImagePro Radiology processes personal information when people use its products, services or online platforms.

By using those products, services or platforms, users accept and consent to the practices described in the approved policy.

2. Interpretation and definitions

Words defined in the Protection of Personal Information Act No. 4 of 2013 (POPIA) have the same meaning in this policy unless the context requires otherwise.

Consent includes electronic methods used to communicate acceptance, such as submitting information, subscribing, updating a profile, clicking an acceptance button or otherwise choosing to provide information.

3. Introduction

ImagePro Radiology recognises the importance of protecting privacy and aims to balance its legitimate business interests with each person’s reasonable expectation of privacy.

Appropriate and reasonable technical and organisational safeguards are used to prevent unauthorised access or disclosure. Absolute security cannot be guaranteed.

Where there are reasonable grounds to believe information has been accessed or acquired by an unauthorised person, affected individuals and the Information Regulator will be notified as required by POPIA. A notification may be delayed where a competent public body or the Regulator determines that it could impede a criminal investigation.

A security-compromise notification will provide sufficient information to help affected people take protective measures against its potential consequences.

4. Consent

By continuing to use ImagePro Radiology products, services or online platforms, users agree to this policy and consent to the processing of their personal information to provide access to those products, services and platforms, as well as for the other purposes described in this policy.

A person who does not agree should stop using the relevant products, services or platforms, including products or services provided by ImagePro Radiology partners.

5. Variation of this Privacy Policy

ImagePro Radiology may update this policy and provide users with an opportunity to review a revised version. Visitors should familiarise themselves with the latest published version whenever they use the website or related services.

6. Personal information we may process

ImagePro Radiology may process the categories of personal information necessary to provide products and services and protect legitimate business interests. Depending on how a person interacts with ImagePro Radiology, this may include:

• Identity, demographic and contact information: a name, identity number, email address, telephone number, physical or postal address, race, gender, age, views and other information voluntarily provided.
• Information and content supplied: consent records, communications, messages, account details, content, preferences and other information submitted when using products, services or website features.
• Usage information: content viewed or engaged with, features used, actions taken, accounts interacted with, and the time, frequency and duration of activities.
• Device information: operating system, hardware and software versions, browser, applications, files, plugins, device operations, identifiers, device settings and device signals.

ImagePro Radiology requires partners to have lawful rights to collect, use and share information before providing it. Processing is limited to information for which consent has been provided, which is necessary for legitimate business interests, or which may otherwise lawfully be processed.

7. When we process personal information

Information may be processed when someone visits, browses, registers, subscribes, applies for or uses a product, service or website; registers for notifications; participates in research; where processing is required by law; or where it is in that person’s best interests.

8. How we use personal information

• To deliver and personalise products, services, website features, suggestions, advertisements and relevant content according to connections, preferences, interests and activities.
• To develop, test, troubleshoot and improve services and website functionality.
• To select and personalise advertisements, offers and sponsored content.
• To provide measurement, analytics and other lawful business services, including helping authorised partners assess the effectiveness and distribution of their services and advertising.

9. Where we store personal information

Information may be stored manually and/or on secure cloud-based platforms and servers operated, maintained and protected in the Republic of South Africa.

Information may also be transferred to, stored or processed outside South Africa by ImagePro Radiology or its suppliers, content providers and service providers. Reasonable steps will be taken to ensure secure treatment in accordance with this policy. A transfer to a country without data-protection legislation substantially similar to POPIA will take place only with consent, where required by law, or under an agreement that provides adequate safeguards.

Where a person has been given or has chosen a password to access parts of the website, that person is responsible for keeping it confidential and should not share it with anyone.

Records are not retained longer than necessary for operational or archiving purposes unless retention is required or authorised by law. Longer retention for historical, statistical or research purposes is subject to appropriate safeguards, such as de-identification.

Internet transmission is not completely secure. Appropriate and reasonable technical and organisational safeguards are used, but electronic transmission remains at the sender’s own risk.

10. Sharing personal information

Personal information is not disclosed without consent or permission unless disclosure is required by law or is in the data subject’s best interests.

Information may be shared with authorised holding or subsidiary companies, agents, advisers, partners, suppliers and service providers, or transferred to a new owner as part of a lawful change in ownership or control.

Information may also be disclosed where required by law or where disclosure is reasonably necessary to identify, contact or take legal action against a person who may be breaching applicable terms, interfering with rights or property, or causing harm to ImagePro Radiology, its users or another person.

11. Your rights

• Request correction, destruction or deletion of qualifying personal information that is inaccurate, irrelevant, excessive, outdated, incomplete, misleading, unlawfully obtained or no longer authorised for retention.
• Withdraw consent at any time. Withdrawal does not invalidate processing already completed and does not prevent processing that remains necessary or authorised for legal obligations, public-law duties, contractual performance, or the protection of legitimate interests.
• Object at any time, on reasonable grounds relating to a particular situation, to processing that is not required by law, a public-law duty or an applicable legitimate interest.
• Object to processing for direct marketing and decline unsolicited electronic marketing from unknown third parties where consent has not been given.
• Submit a complaint to the Information Regulator about an alleged interference with the protection of personal information.
• Institute civil proceedings regarding an alleged interference with the protection of personal information where permitted.

12. Use of cookies

Cookies are pieces of information transferred to a user’s device for record-keeping. They may save preferences, track online habits and traffic patterns, support website functionality, and help avoid showing the same advertisement too often.

ImagePro Radiology may place a cookie on a browser to store and sometimes track information. Browser settings can be changed to refuse cookies or indicate when a cookie is sent, although parts of the website or services may not work correctly when cookies are disabled.

13. Links to other sites

Products, services or the website may direct users to third-party sites beyond ImagePro Radiology’s control. Those sites may use their own cookies, collect data or request personal information. ImagePro Radiology does not control their privacy policies and cannot accept liability for a person’s use of them.

Users must keep usernames and passwords secret and must not provide them to anyone. A user remains solely responsible for any loss suffered if another person uses those credentials.
