How ImagePro Radiology processes, uses, stores, shares and protects personal information in accordance with POPIA.

1. Purpose of this Privacy Policy

This policy explains the basis on which ImagePro Radiology processes personal information when people use its products, services or online platforms.

By using those products, services or platforms, users accept and consent to the practices described in the approved policy.

2. Interpretation and definitions

Words defined in the Protection of Personal Information Act No. 4 of 2013 (POPIA) have the same meaning in this policy unless the context requires otherwise.

Consent includes electronic methods used to communicate acceptance, such as submitting information, subscribing, updating a profile, clicking an acceptance button or otherwise choosing to provide information.

3. Introduction

ImagePro Radiology recognises the importance of protecting privacy and aims to balance its legitimate business interests with each person’s reasonable expectation of privacy.

Appropriate and reasonable technical and organisational safeguards are used to prevent unauthorised access or disclosure. Absolute security cannot be guaranteed.

Where there are reasonable grounds to believe information has been accessed by an unauthorised person, affected individuals and the Information Regulator will be notified as required by POPIA. A notification may be delayed where a competent public body or the Regulator determines that it could impede an investigation.

5. Variation of this Privacy Policy

ImagePro Radiology may update this policy and provide users with an opportunity to review a revised version. Visitors should familiarise themselves with the latest published version whenever they use the website or related services.

6. Personal information we may process

The categories depend on how a person interacts with ImagePro Radiology and may include:

  • Identity, demographic and contact information, including a name, identity number, email, telephone number, physical or postal address, age, gender and other information voluntarily provided.
  • Communications, content, messages, preferences and information submitted when using services or website features.
  • Usage information, including pages viewed, features used, actions taken and the time, frequency and duration of activities.
  • Device attributes, device operations, identifiers, settings, signals, network details, IP addresses and cookie data.
  • Information lawfully supplied by partners, service providers, publishers, developers, advertisers or other authorised third parties.

Processing is limited to information for which consent has been provided, which is required for legitimate business interests, or which may lawfully be processed.

7. When we process personal information

Information may be processed when someone visits, browses, registers, subscribes, applies for or uses a product, service or website; registers for notifications; participates in research; where processing is required by law; or where it is in that person’s best interests.

8. How we use personal information

  • To provide and personalise products, services, website features and relevant content.
  • To develop, test, troubleshoot and improve services and website functionality.
  • To provide measurement, analytics and other lawful business services.
  • To promote safety, security and integrity, verify activity and investigate suspicious conduct.
  • To communicate about services, policies and terms, respond to enquiries and send authorised marketing communications.
  • To conduct research, support innovation, assist with future dealings and perform other activities authorised by law.

9. Where we store personal information

Information may be stored manually or on secure cloud platforms and servers. Where information is transferred outside South Africa, reasonable measures will be taken to ensure appropriate safeguards in accordance with POPIA.

Records are not retained longer than necessary for operational or archiving purposes unless retention is required or authorised by law. Longer retention for historical, statistical or research purposes is subject to appropriate safeguards, such as de-identification.

Internet transmission is not completely secure. Reasonable safeguards are used, but people transmit information electronically at their own risk.

10. Sharing personal information

Personal information is not disclosed without consent or permission unless disclosure is required by law or is in the data subject’s best interests.

Information may be shared with authorised holding or subsidiary companies, agents, advisers, partners, suppliers and service providers, or transferred as part of a lawful change in ownership or control. It may also be disclosed where necessary to protect rights, property, users or another person from harm.

11. Your rights

  • Request correction, destruction or deletion of qualifying personal information that is inaccurate, irrelevant, excessive, outdated, incomplete, misleading, unlawfully obtained or no longer authorised for retention.
  • Withdraw consent, subject to processing already completed and lawful processing or retention obligations.
  • Object on reasonable grounds to processing that is not required by law or justified by an applicable legitimate interest.
  • Object to processing for direct marketing and decline unsolicited electronic marketing from unknown third parties.
  • Submit a complaint to the Information Regulator or institute civil proceedings where permitted.

12. Use of cookies

Cookies support record keeping, preferences, website functionality and the analysis of traffic or online activity. Browser settings can be used to refuse cookies or indicate when a cookie is sent, although parts of the website may not work correctly when cookies are disabled.

14. Direct marketing

Personal information may be processed to provide information about services that may be of interest. Recipients may unsubscribe free of charge at any time using the unsubscribe facility supplied with the communication or by contacting ImagePro Radiology.

15. Passwords and login information

Where registration and login facilities are available, users are responsible for keeping usernames and passwords confidential. Login details must not be shared, and users remain responsible for losses resulting from another person using their credentials.
